Bench Warrant issued for Austin Valdez
Austin Valdez, 21, whose address is sealed by the court, was not in court Friday when his case was called by Judge William Sharp.
Valdez was ordered to appear as the State prosecutors are asking the charge against him to be amended to first degree intentional homicide instead of first degree reckless homicide. Valdez is charged with causing the death of his stepfather, Robin Reeson last year. He has already gone through one trial that resulted in a hung jury.
Valdez notified his attorney, Jeremiah Wolfgang Meyer-O'Day that he could not find transportation to attend the hearing as his truck broke down this week and he could not find anyone to give him a ride. O'Day said that Valdez was available by phone.
Judge Sharp said statutes require Valdez to be present as he is charged with a felony. A bench warrant was then issued for his arrest.
